Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the SendFleet API, dashboard, and related services (the "Service") operated by SendFleet ("we", "us", "our").

By registering an account, creating an API key, or making any request to the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Eligibility

You must be at least 16 years old to use SendFleet. By creating an account you represent that:

• You are at least 16 years of age (or the age of digital majority in your jurisdiction, whichever is greater).
• You have not been previously suspended or removed from the Service.
• Your use of the Service does not violate any applicable law or regulation.
• You are not located in a country subject to a government embargo or designated as a terrorist-supporting country by applicable law.

Your Account

Registration

You must provide a valid email address and a password of at least 8 characters. You are responsible for keeping your credentials confidential and for all activity that occurs under your account.

Account security

Notify us immediately at [email protected] if you suspect any unauthorised access. We are not liable for losses arising from your failure to secure your credentials.

One account per person

You may not create multiple accounts to circumvent plan limits, abuse prevention measures, or any other restriction. Doing so may result in all associated accounts being suspended.

Accurate information

You agree to keep your account information - particularly your email address - accurate and up to date. Accounts with invalid contact details may be suspended without notice.

API Keys

API keys authenticate your requests to the send endpoint. You are solely responsible for any key you generate.

• API keys must be kept confidential. Never commit them to public repositories, embed in client-side code, or share unnecessarily.
• The full secret key is displayed once only at creation. It cannot be recovered - if lost, revoke it and generate a new one.
• Revoke any key instantly from the dashboard. Revocation propagates within 2 minutes via Redis cache.
• Keys may be given expiry dates. Expired keys are automatically refused.
• All actions performed under your API keys are your responsibility, authorised or not.

Acceptable Use

SendFleet is designed for transactional email - messages triggered by a specific user action on your application (sign-up confirmation, password reset, order receipt, alert notifications).

Plans, Limits & Quotas

Monthly usage resets at the start of each calendar month. If you reach your plan's email limit, further API requests return HTTP 429 until the period resets. We reserve the right to modify plan limits with 30 days' notice.

Billing & Payments

Paid plans are billed monthly in advance via Paddle. By subscribing you agree to Paddle's terms in addition to ours.

• All prices are in USD and exclude applicable taxes.
• You may cancel at any time from the dashboard. Cancellation takes effect at the end of the current billing period - no partial refunds.
• Failed payments trigger a 3-day grace period, after which the account is downgraded to the free Starter plan.
• We reserve the right to change pricing with 30 days' notice. Price changes do not apply to the current billing period.

Intellectual Property

Our IP

The SendFleet name, logo, software, API, documentation, and all associated content are owned by or licensed to us and are protected by intellectual property laws. These Terms grant no ownership rights in the Service.

API licence

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the API for the purpose of sending transactional email from your own applications.

Your content

You retain all rights to the content you submit via the API. By submitting content you grant us a limited licence to process, store, and transmit it solely to provide the Service. We claim no ownership over your email content.

Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

• We do not warrant that the Service will be uninterrupted, error-free, or secure.
• Email delivery depends on third-party infrastructure (AWS SES, ISPs, spam filters) that we do not control. We cannot guarantee delivery within any specific timeframe.
• SendFleet is an early-stage product. Features may change, be removed, or be temporarily unavailable without notice.

Limitation of Liability

To the maximum extent permitted by applicable law, SendFleet and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with:

• Your use of or inability to use the Service.
• Failure or delay of email delivery.
• Unauthorised access to or alteration of your data.
• Any third-party conduct or content transmitted through the Service.

Our total aggregate liability for any claim shall not exceed the greater of (a) the total fees you paid us in the 3 months preceding the claim, or (b) USD $10.

Termination

By you

You may delete your account at any time from dashboard Settings. Account data is scheduled for permanent removal within 30 days per our Privacy Policy.

By us

We may suspend or terminate your account if you breach these Terms, we reasonably believe your account is being used for illegal or harmful activity, your account has been inactive for more than 12 months on a free plan, or we receive a valid legal order requiring us to do so. Where reasonably possible we will give notice before termination.

Effect of termination

Upon termination, your right to access the Service ceases immediately. Sections covering intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.

Dispute Resolution

Before initiating any formal proceeding, you agree to contact us at [email protected] and give us 30 days to attempt informal resolution.

If informal resolution fails, disputes shall be resolved by binding arbitration conducted in English. Class actions and class arbitrations are expressly waived to the extent permitted by law. Nothing prevents either party from seeking injunctive or equitable relief from a court where necessary to protect intellectual property or prevent irreparable harm.

Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Where mandatory local consumer-protection laws provide greater rights, those laws take precedence. If any provision is found unenforceable, the remaining provisions remain in full force.

Changes to These Terms

We may update these Terms as SendFleet evolves. For material changes:

• We update the "Last reviewed" date at the top of this page.
• We email all registered accounts with at least 14 days' notice.
• For significant changes affecting your rights, we may request explicit re-acceptance.

Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
